The Food Safety and Standards Authority of India (FSSAI)has been established under Food Safety and Standards , 2006 which consolidates various acts & orders that have hitherto handled food related issues in various Ministries and Departments. FSSAI has been created for laying down science based standards for articles of food and to regulate their manufacture, storage, distribution, sale and import to ensure availability of safe and wholesome food for human consumption.

To provide assurance of food safety, Food businesses must implement an effective Food Safety Management System (FSMS) based on Hazard Analysis and Critical Control Point (HACCP) and suitable pre- requisite programmes by actively controlling hazards throughout the food chain starting from food production till final consumption.

As per the condition of license under FSS (Licensing & Registration of Food Businesses) Regulations 2011, every food business operator (FBO) applying for licensing must have a documented FSMS plan and comply with schedule 4 of this regulation. Schedule 4 introduces the concept of FSMS based on implementation of Good Manufacturing Practices (GMP) and Good Hygiene Practices (GHP) by food businesses and is divided into five parts as under:.

Hawker Restaurant is a type of food service operation which prepares, serves food and drinks to customers in exchange for money. Meals are generally served and eaten on the premises, but many restaurants also offer take-out and food delivery services, and some offer only take-out and delivery. Dhaba: Food service establishment generally located near roadside/highway involved in processing, storing, packaging and selling of food to customers for consumption. Boarding Houses Serving Food: A building providing food and lodging for paying guest. Food stalls/ Arrangements in religious gatherings/ fairs etc: A stand/booth/compartment/small covered area being used for preperation and /or sale or distribution of of freshly prepraed or packaged food being offered as prasad in an religious institution. Canteen or Cafeteria is a dining area in an institution/ establishment serving food (being prepared in the premises or procured from other location or source) to individuals associated with or visisting the instiution. Food Service Establishment involved in preperation and serving of food for consumption of a group of individuals working or visiting offices of railways. Hotel is a commercial establishment providing lodging, meals, and other guest services. In general, to be called a hotel, an establishment must have a minimum of six letting bedrooms, at least three of which must have attached (ensuite) private bathroom facilities. The Midday Meal Scheme is a school meal programme of the Government of India designed to better the nutritional standing of school-age children nationwide. The programme supplies free lunches on working days for children in primary and upper primary classes in government, government aided, local body, Education Guarantee Scheme, and alternate innovative education centres, Madarsa and Maqtabs supported under Sarva Shiksha Abhiyan, and National Child Labour Project schools run by the ministry of labour. Caterer preparing and transporting food to institutions under Midday meal scheme. Canteen or Cafeteria is a dining area in an institution/ establishment serving food (being prepared in the premises or procured from other location or source) to individuals associated with or visisting the instiution.

Storage (Except Controlled Atmosphere and Cold) Storage is an activity where food products in packed or unpacked condition is stored for further distribution in storage facilities, also called warehouses, godowns etc

Storage (Cold / Refrigerated) Cold/refrigerated storage is an activity where refrigerated/frozen food products in packed or unpacked condition is stored for further distribution in refrigeration/freezing storage facilities.

Storage (Controlled Atmosphere + Cold) Controlled Atmosphere storage is an activity where food products in packed or unpacked condition is stored for further distribution in controlled atmosphere storage facilities. A controlled atmosphere, generally used for storage of dry commodities & agricultural produce in which the concentrations of oxygen, carbon dioxide and nitrogen, as well as the temperature and humidity of a storage room are regulated.

Wholesaler Wholesale is an activity in the distribution channel where food product is procured in bulk and then sold to resellers/retailers rather than to consumers.

Distributor Distribution is an activity in the distribution channel where food product is distributed from the original place of manufacture to the person who makes the final delivery or sale of the food product to the ultimate consumer.

Transportation (having a number of specialized vehicles like insulated refrigerated van/ wagon and milk tankers etc.) Transportation is an activity of transporting food products (both packed and bulk) from one location to another in vehicles/containers including specialized vehicles like insulated refrigerated van/ wagon, oil/milk tankers etc.

Retailer Retail is an activity where food products is procured from a manufacturer, distributor or wholesaler and sold to the ultimate end user.

Food Vending Agencies Sale of packaged/fresh food from a temporary or fixed stall/cart/ machine by an individual or by automation.

Importer Import is an activity where articles of trade from a foreign source is brought into a domestic market in the course of trade.

Note: To apply under importer category FBO must have IE Code from DGFT. The address of premises in case of importer should be same as mentioned in IE Code. Even if importer is having multiple premises, only 1(One) license is applicable, if applying for importer Kind of Business only.

GSTN enables New Registration functionality for Insolvency Resolution Professionals

The Goods and Services Tax Network (GSTN) has enabled New Registration functionality on the GST portal for erstwhile registered entities who are now corporate debtors under the provisions of the Insolvency and Bankruptcy Code (IBC), 2016. This facility will benefit the companies which are undergoing the corporate insolvency resolution process and whose management affairs are being undertaken by Interim Resolution Professionals (IRP) or Resolution Professionals (RP).

To use this functionality, the appointed IRP/RP should choose the reason to obtain new registration in the drop down menu as “Corporate Debtor undergoing the Corporate Insolvency Resolution Process by IRP/RP” while applying for registration on the GST portal. 

The CBIC, in its notification no. 11/2020 dated 21st March 2020, had stated that the corporate debtors shall be liable to obtain new registration through IRP/RP. Accordingly, the IRP/RPs can apply for new registration on behalf of corporate debtors within 30days from their appointment or by 30th June 2020, whichever is later. The registration can be applied in each of the States/UTs where the corporate debtor was registered earlier. 

A corporate debtor undergoing insolvency is liable to furnish its GST returns, make payment of tax and meet all other GST compliances as per the GST law during the corporate insolvency resolution process (CIRP) period. Such corporate debtors shall be treated as distinct person and they are liable to take new registration through IRP/RP w.e.f. the date of appointment of such IRP/RP for management of affairs of the corporate debtors

Continue with the Old GSTIN Corporate debtors who have not defaulted in furnishing the return under GST would not be required to obtain a separate registration. Accordingly, if statements in FORM GSTR-1 and returns in FORM GSTR-3B for all the tax periods prior to the appointment of IRP/RP have been furnished under the registration of Corporate Debtor (earlier GSTIN), the IRP/RP would not be required to take a fresh registration. In such cases, the IRP/RP is made Authorised Signatory under non-core amendment and they can continue using the same GSTIN
